Vesper Desk Refund Policy
Effective date: October 14, 2026
Operator: Justin Farmer DBA Vesper Desk, a sole proprietorship in Kansas, United States
Contact: support@vesperdesk.app
1. Scope and priority
This policy applies to paid Vesper Desk purchases we actually offer. The checkout and receipt identify the seller or merchant of record, including Lemon Squeezy where used. Free access does not involve a payment to refund. A beta label does not establish whether a payment has been taken; your receipt and checkout control.
This policy supplements the Terms of Service and EULA and controls refund questions if their wording differs. Nothing here limits mandatory withdrawal rights, consumer guarantees, remedies for defective or misdescribed digital content or services, or payment-error rights.
2. Seven-day first-payment refund
A new subscriber may receive a full refund of their first Vesper Desk subscription payment by sending a request within seven calendar days after that payment. No technical defect or reason is required. A timely request is sufficient even if we review it later. This offer applies to the first payment for a monthly or annual subscription; renewals, upgrades, and repeat subscriptions do not start a new goodwill window. Normal use or downloading the app during that window does not invalidate the offer.
Later payments are ordinarily non-refundable solely for a change of mind. That rule does not apply to a statutory remedy, an unlawful or duplicate charge, a payment after effective cancellation, or a refund promised when we discontinue prepaid access. Requests based on those grounds are assessed separately and are not limited to seven days.
3. Mandatory consumer rights
Consumers in the EEA, UK, and other relevant jurisdictions may have a 14-day statutory withdrawal period for distance contracts, ordinarily beginning when the contract for digital content or services is concluded. Longer periods or extensions may apply if required information was not provided. This legal right is separate from our seven-day goodwill offer.
For digital content not supplied on a tangible medium, a withdrawal right is lost only where applicable law allows and all required conditions are met, including your prior express consent to immediate supply, acknowledgment that beginning supply loses the right, and the required contract confirmation. Downloading software or accepting general terms alone is not a sufficient waiver. The loss of a statutory withdrawal right does not cancel our seven-day offer or defect remedies.
For ongoing services, merely starting access does not automatically eliminate withdrawal rights. If you expressly request performance during the withdrawal period and the required information has been supplied, law may permit a proportionate charge for service delivered before withdrawal. Loss of a service withdrawal right on full performance requires the separate conditions prescribed by law. We will not apply a digital-content waiver to a service indiscriminately.
If software or a digital service fails to conform to the contract, applicable law may provide repair, replacement, repeat performance, price reduction, termination, or a refund. These remedies may extend beyond both seven and 14 days. Australian consumers retain their applicable consumer guarantees, including major-failure remedies and compensation for reasonably foreseeable loss. We will not require troubleshooting or an alternative remedy where law gives you an immediate refund entitlement.
4. Bespoke items, digital delivery, and credits
We do not promise that custom work or standalone digital items are currently sold. If offered later, their scope, price, acceptance criteria, and cancellation terms will be disclosed before purchase.
Truly personalized goods, fully performed custom services, and immediately supplied digital content may be excluded from change-of-mind refunds only where the applicable legal exception and its conditions are satisfied. Calling a digital item "bespoke," "delivered," or "non-refundable" is not enough to remove mandatory rights. Unperformed custom work and defective or misdescribed items remain subject to applicable remedies. The seven-day subscription offer applies to subscriptions, not separate custom-work orders.
Free promotional credits and referral rewards have no cash value and ordinarily cannot be refunded for cash. Purchased gift codes are treated according to their disclosed purchase terms and applicable gift-card, withdrawal, and consumer laws; they are not categorically non-refundable merely because they are codes. We refund payments only to the extent actually made and do not convert free credits into cash.
5. How to request a refund or withdraw
Email support@vesperdesk.app with your account or purchase email, order or transaction reference, payment date, and the payment concerned. For the seven-day offer, state that you want your first-payment refund. For a billing error or defect, provide enough detail to identify the issue. We may request reasonable proof of purchase, but never a password or full card number. A statutory withdrawal may be made by any clear statement; a particular subject line or explanation is not required.
Optional withdrawal wording: "I withdraw from my Vesper Desk contract made on [date], order [reference]. My name and contact email are [details]." Send it to the contact above. A signature is required only if submitted on paper where applicable.
We aim to acknowledge requests within three business days. For an approved goodwill refund, we submit the refund within 14 calendar days of receiving the request. For statutory withdrawal, we reimburse within the deadline required by law, ordinarily within 14 days of being informed of withdrawal. Refunds use the original payment method unless you agree to another lawful method, without a refund fee. Bank posting times may add delay. We explain any refusal and the basis for it.
Where an independent merchant or app store processes the purchase, its refund channel may be required to execute payment. We will identify that channel and assist you; this does not remove rights or responsibilities that law places on us. Do not obtain duplicate reimbursement for the same payment. This does not restrict lawful chargeback or regulator rights.
6. Cancellation and effect of refunds
Cancel through Manage billing or the method in your receipt to stop future renewals. Contact us if that method is unavailable. Cancellation alone ordinarily retains paid features to the end of the paid period and does not automatically request a refund.
A full subscription refund ends the refunded paid access and cancels related future renewal; free access may remain if available. For partial refunds, we explain the affected access. We do not withhold legally required data retrieval simply because access is refunded. If we discontinue prepaid access without your material breach, we refund the unused affected portion as the Terms provide.
7. Governing law and changes
Kansas law and applicable United States federal law govern contractual refund issues subject to mandatory local consumer protections and the consumer-court protections in the Terms. This clause does not shorten statutory refund deadlines. Future policy changes apply prospectively to new purchases or properly notified renewals and do not remove rights attached to existing purchases.
